Acknowledgment of Risk

I understand that Sparks Lake Resort is a natural, outdoor environment and that activities offered or available at the resort involve inherent risks, including but not limited to:

• Boating, kayaking, canoeing, paddle boats, and fishing
• Swimming, wading, and dock use
• Uneven terrain, trails, and wooded areas
• Wildlife encounters, including insects, snakes, and other animals
• Weather-related conditions, including heat, rain, storms, and wind
• Water hazards, slipping hazards, changing lake conditions, and limited visibility
• Risks associated with docks, shorelines, the dam, the spillway, and the fountain area

I acknowledge that these risks may result in injury, illness, property damage, or death, and I voluntarily choose to participate in these activities.

Boats, Watercraft, and Lake Use

I understand that all boats, kayaks, canoes, paddle boats, and similar lake equipment are used entirely at my own risk. I acknowledge that I should only participate in lake activities if I am physically capable of doing so and if I know how to safely operate or ride in the watercraft being used.

I understand and agree that:

• All guests using any boat, kayak, canoe, paddle boat, or other floating equipment must be able to reliably and safely use that equipment
• Guests are responsible for knowing how to enter, operate, balance, steer, and exit a watercraft safely before use
• Sparks Lake Resort does not provide boating instruction, water rescue supervision, or on-water guides unless specifically stated otherwise
• Any guest who is not comfortable, experienced, or capable of safely using a boat or watercraft should not participate
• Life vests are required for all lake activities and while using any boat, canoe, kayak, paddle boat, dockside water equipment, or similar floating device
• Children are not allowed in boats, canoes, kayaks, paddle boats, or similar watercraft alone
• Minors must remain under direct adult supervision at all times during any lake or dock activity

Restricted Areas and Required Distances

I understand that certain parts of the property present elevated danger and must be avoided at all times.

• Guests must stay at least 30 feet away from the fountain area at all times
• Guests must stay at least 30 feet away from the dam and spillway area at all times
• Climbing, standing, walking on, or entering the dam or spillway area is strictly prohibited
• Boats and floating equipment must not be taken near the dam, spillway, or fountain
• No diving is permitted from docks, boats, or lake structures

Property Boundaries, Trails, and Neighboring Land

I understand that Sparks Lake Resort is surrounded by private property and natural areas that may not be open for guest access.

• Neighboring properties must be respected at all times
• Guests may not enter neighboring land, adjacent private areas, or nearby wooded areas without explicit permission
• Guests must remain only in approved and designated guest areas, lake access areas, marked trails, and authorized resort spaces
• Venturing into wooded areas off approved paths is done at my own risk and is not permitted unless expressly authorized by resort management
• I am responsible for all members of my party staying within approved resort boundaries

Assumption of Responsibility

I agree that I am solely responsible for my own safety and the safety of all members of my party, including minors.

I understand that:

• Life vests are required for all lake activities
• Adult supervision of minors is required at all times
• I am responsible for following all posted rules, boundary limits, and staff instructions
• I must review and follow the full resort rules and safety guidance located at /resort-rules-safety/

Release of Liability

To the fullest extent permitted by Texas law, I hereby release, waive, discharge, and hold harmless Sparks Lake Resort LLC, its owners, managers, employees, agents, and affiliates from any and all claims, demands, actions, or causes of action arising out of or related to my participation in lake or outdoor activities, including claims based on negligence.

Indemnification

I agree to indemnify and hold harmless Sparks Lake Resort LLC from any claims, damages, losses, or expenses, including reasonable attorney’s fees, arising from my actions or the actions of any member of my party during my stay.

Medical & Emergency Consent

In the event of an emergency, I authorize Sparks Lake Resort to obtain medical treatment on my behalf if necessary. I understand that I am responsible for all medical costs incurred.

Binding Agreement

I understand that by making a reservation, entering the property, or participating in activities, I am agreeing to this Waiver on behalf of myself and any minors in my care. This Waiver shall be governed by the laws of the State of Texas.

Severability

If any portion of this Waiver is found to be invalid or unenforceable, the remaining portions shall remain in full force and effect.

Acceptance

By booking a reservation or participating in activities at Sparks Lake Resort, I acknowledge that I have read, understand, and agree to this Lake & Outdoor Activity Waiver, and that I also agree to follow the resort rules and safety requirements published at /resort-rules-safety/.
